OPERATIONAL ISSUES
Commercial contracts; know what you’re signing up to!
Tailored training for your sales force, ensuring they do not enter inadvertently into contracts which do not meet your commercial objectives.
Your sales team needs to understand that a chain of emails, for example, could amount to a contract. Therefore it is important that they have a grounding in commercial contracts, which this session will provide. Specifically, we will give an overview of the typical contracts you will use, with a real worked example of a situation which went wrong. From this we will explain how to avoid this scenario, highlight the potential issues which can make drafting and negotiations risky, and explain how to get around them.
Making rent reviews work for you
A guide to rent review provisions, specifically as they apply to pubs and restaurant businesses.
We will start with an overview of a rent review clause, using worked examples relevant to the industry. This will focus on issues of vacant possession, fit out and permitted use, moving onto the potential pitfalls that can arise during negotiations, their consequences and how to avoid them.
Negotiating trouble free break clauses
Identifying the potential traps in pub and restaurant leases is particularly important in the current economic climate.
You will be guided through break clauses, helping you to understand the underlying contradictions and issues which can arise. We will also take you through what can be learnt from case law and cover key points in negotiations – to ensure you avoid unwelcome consequences.
TUPE – navigating the minefield
An overview of how TUPE impacts on businesses in the sector.
A regular minefield, we will help you understand the indications that a transaction is in fact a TUPE transfer. You will also learn how to ensure you comply – and the consequences of not doing so.
Licensing: key considerations for managers
Our practical workshop is suitable for small groups of managers who need to have an understanding of the law and their responsibilities in relation to licensing.
This half day session provides the opportunity for plenty of interaction, to ensure that the practical application of the Licensing Act is fully understood. As well as a brief backdrop to the Act, we will go on to explore the key elements with which managers of licensed premises must comply.
We are also BIIAB accredited tutors and can provide training and examinations for the APLH.
INDUSTRY REGULATION
The Statutory Code: some thoughts from a veteran!
In addition, our experts in the pub sector can throw some light on the questions arising from the consultation on a Statutory Code for the industry.
In particular, we will address how the industry arrived at the current position, the Government’s changing tactics and their latest proposals. Having seen debates over the trading tie and EU intervention over a number of years, we can also provide some thoughts on the likely consequences of a Statutory Code and the impact that will be felt by operators.
LOCATION AND BOOKING
All training can be delivered at a fully equipped training facility at one of our regional offices, which provide comprehensive coverage of the country, or at your own premises. Courses will generally last for around 2 hours, unless otherwise stated, but can be tailored to individual requirements. Supporting notes will be provided for future reference, and there will be adequate opportunity for questions/dialogue with our legal experts.
